2. General Provisions
These terms and conditions apply to all agreements
between Milenst BV (operating under the name Grafzorg.be) and the customer
regarding grave maintenance services. By using our
services, you agree to these terms and conditions.
Milenst BV is a company incorporated under Belgian law, registered with
the Crossroads Bank for Enterprises under number BE1011.071.778.
Definitions:

Milenst BV / Grafzorg: The service provider,
located at Krommelei 1A, 2110 Wijnegem

Customer: The natural or legal person who enters into a
agreement

Services: All grave maintenance and care services provided by Milenst BV under the name
Grafzorg

Subscription: Regular services provided according to
an agreed schedule
3. Services
Available Services:
- Monthly and quarterly grave maintenance
- Bouquet service and floral arrangements
- Seasonal decorations (fall, winter, spring)
- Photo report after each service
- Special services for commemorative days
Implementation:
- Services are performed according to the agreed schedule
- Weather conditions can affect performance
- If you are unable to attend, an alternative date will be arranged
- Access to the cemetery is required
4. Prices and Payment
Rates:
- All prices include VAT unless otherwise stated
- Prices are subject to annual adjustment
- Changes will be communicated 30 days in advance
Terms of Payment:
- Subscriptions are billed annually in advance
- Payment within 30 days of the invoice date

If payment is not made on time, services may be suspended
- Collection fees are the customer's responsibility
5. Customer Obligations
- Provide accurate information about the grave location and access
- Please let us know of any special requests in advance
- Please notify us of any changes to your contact information
- Ensure access to the cemetery
- Timely payment of invoices
- Treating our employees with respect
6. Subscriptions
Term:
- Subscriptions have a minimum term of 1 year
- Automatic renewal for one year unless canceled
- Notice of cancellation must be given at least 1 month before the due date
Changes:
- Subscriptions can be changed at any time
- Changes will take effect starting with the next billing period
- Downgrades are possible, but no refunds will be issued
7. Right of Withdrawal and Cooling-Off Period
Right of withdrawal:

Consumers have a 14-day right of withdrawal following the
conclusion of the contract

The right of withdrawal expires once the service has begun
with the customer's express consent

If the contract is canceled in a timely manner, any amounts already paid will be refunded
Cooling-off period:

For contracts entered into remotely, the consumer has a 14-day
cooling-off period

The cooling-off period begins on the day after the contract is signed

During the cooling-off period, the agreement may be terminated without giving a reason
8. Liability
Grafzorg's Liability:
- We provide our services with care and expertise

Liability is limited to the value of the services provided
- No liability for damage caused by weather conditions
- Adequate professional liability insurance
Exceptions:

No liability in cases of force majeure (weather, access issues)
- Limited liability for damage to gravestones
- Excluded: indirect damages and lost profits
9. Complaints and Disputes
Complaints Procedure:
- Report complaints within 7 days of the service being provided
- Submit in writing, including photos if applicable
- We will respond within 5 business days
- Working together to find a suitable solution
Dispute Resolution:
- Belgian law applies
- The Court of Antwerp has jurisdiction over disputes
- Preference for an out-of-court settlement

Consumers can contact the Dispute Resolution Committee for
Consumer Affairs (www.belmed.be)
- European Online Dispute Resolution platform: ec.europa.eu/odr
10. Force Majeure
Milenst BV cannot be held liable for failure to fulfill
its obligations if such failure is due to force majeure.
Force majeure is defined as:

Extreme weather conditions that make work impossible
- Natural disasters, fire, flooding
- Pandemic or epidemic
- War, terrorism, civil war
- Strikes, work stoppages
- Government measures that hinder the provision of services

Limited access to cemeteries due to circumstances beyond our
control
11. Cancellation and Termination
By the Customer:
- Written notice of cancellation must be given 1 month before the due date
- No refunds for prepaid amounts
- Services will be provided until the end of the term
By Grafzorg:
- In the event of non-payment after the second reminder
- If we are unable to provide our services
- In the event of a material breach by the customer
- Subject to a one-month notice period
12. Privacy and Data Protection
We respect your privacy and comply with the GDPR. For
more detailed information, please refer to our Privacy Policy.
- Minimum data collection for service provision
- Secure data storage and processing
- No resale to third parties
- Right to access and correction
13. Final Provisions
- These terms and conditions are subject to change
- Changes will be communicated 30 days in advance
- In the event of any conflict, these general terms and conditions shall prevail
- The invalidity of a provision does not affect the rest
- These terms and conditions have been drawn up in accordance with Belgian law
